CJ Logistics America, LLC and its affiliates (“CJ,” “we,” “us,” or “our”) respect the privacy of our employees, job applicants, and independent contractors (collectively, “you”). In this Privacy Notice for Employees, Job Applicants, and Independent Contractors (this “Employee Privacy Notice”), we describe how we collect, use, retain, and disclose your Personal Information in the employment context, the rights available to you and how to exercise those privacy rights.

Please note that this Employee Privacy Notice only applies to residents of the state of California and residents of Canada. It does not cover Personal Information collected from you as a consumer. Please see the CJ Logistics North American Consumer Privacy Policy for more information about our privacy practices. In the event of any conflict, this Employee Privacy Notice controls with respect to Personal Information in the employment context.

References to employment, engagement, personnel, or similar terms in this Employee Privacy Notice are used for convenience only. This Employee Privacy Notice does not confer employment status on any non-employee, does not form part of any employment or engagement contract, and does not create contractual rights or obligations between you and us.

1. Definitions

The following words are defined terms under this Employee Privacy Notice:

“Employee(s)” means an individual who is employed by CJ as a full-time or part-time employee or temporary worker.

“Employment Context” means a stage of an individual’s relationship with CJ as an Employee, Job Applicant, or Independent Contractor, including during the recruitment and application process, during active employment or engagement, and upon separation or termination.

“Independent Contractor(s)” means an individual who provides services to CJ pursuant to a written contract.

“Job Applicant(s)” means an individual who has applied for a job with CJ.

“Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household, or as described in applicable privacy laws. Personal Information does not include publicly available information, deidentified information, or aggregated information.

“Process,” “processed,” or “processing” means any operation or set of operations performed on Personal Information, whether or not by automated means.

“Sensitive Personal Information”, as applicable to California Workforce Members, means Personal Information that reveals a consumer’s social security number, driver’s license, state identification card, or passport number; account log-in, financial account number, debit card number, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; precise geolocation; racial or ethnic origin, citizenship or immigration status, religious or philosophical beliefs, or union membership; contents of email or text messages not intended for us; and genetic data. Sensitive Personal Information also includes processing of biometric information for the purpose of uniquely identifying a consumer and Personal Information collected and analyzed concerning a consumer’s health, sex life, or sexual orientation. For Canadian Workforce Members, personal information may be considered sensitive based on the nature of the information (such as medical, biometric, or intimate information) or the context of its use, as determined under applicable Canadian privacy law.

“Workforce Members” means Employees, Job Applicants and Independent Contractors who are entitled to certain privacy rights under applicable privacy laws.

“You” or “your” means an Employee, Job Applicant, or Independent Contractor, as applicable, as those terms are defined in this Employee Privacy Notice.

2. Categories of Personal Information We Collect

We may collect the following categories of Personal Information from Workforce Members in the Employment Context:

City, state, zip code, and country (based on an IP address)

CCTV footage, call recordings, audio recordings, video recordings, photographs, and videos.

We operate cameras at our facilities, including on our forklifts, and may use pictures or video from those cameras for security purposes.

Current or past job history, performance evaluations, employment records, job applications, resumes, certificates and licenses, work schedule and status, compensation history, work eligibility information, disciplinary records, employment contracts, Independent Contractor agreements, Employee expense information, health insurance information, leave and accommodations information, workers compensation or similar claims data, payroll and benefits-related data, beneficiary information, and contact information.

Education information

Information about your educational background protected under the Federal Educational Rights and Privacy Act (FERPA), including grades, transcripts, and student ID information.

Inferences and preferences

Preferences drawn from any of the information listed above to create a profile about an individual reflecting the individual’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, abilities, and aptitudes (e.g., predictions about an individual’s preferences or tendencies).

Processing of Sensitive Personal Information

We may request certain Sensitive Personal Information from you in connection with your application or during your employment. Except where we are required to collect such information under applicable law (such as your social security number and your driver’s license if you are a driver or applying for a driver’s position), our requests for Sensitive Personal Information are voluntary.

3. Sources of Personal Information We Collect

We may collect Personal Information about you from the following sources:

  • Information You Provide to Us Directly. Directly from you, for example, when you apply for a job, complete payroll and benefits forms, or participate in benefits programs.
  • Information We Collect Electronically. Information we collect electronically when you use our company equipment, vehicles, or our IT systems.
  • Information We Collect from Third Parties. Information we collect from our parent company, affiliated companies, business partners, service providers and recruiters, as permitted by law.

We utilize imprecise geolocation data to track the location of forklifts within our facilities for safety purposes and track company laptops. We also monitor and analyze the location of user logins to help identify suspicious activity and as part internal investigations. We also log which company devices are connected to specific wireless access points within our buildings.

Security and Facilities Monitoring

To maintain the security of our IT systems and our business information, to conduct internal audits and investigations, to manage safety and security protocols for Workforce Members, and visitors to our facilities, to protect CJ and third parties against illegal activity and misconduct, such as fraud, deceptive practices, and unauthorized access to or acquisition of Personal Information

 

We monitor the use of our IT systems, facilities, computers and other electronic devices, including through cameras and CCTV at certain CJ facilities. These devices may capture your image or information about your movements and may be used to protect the safety of our Workforce Members, visitors, facilities, and property.

Driver Monitoring

We collect Biometric information of our CJLT / Driver population for safety purposes. We track tractors and trailers within 300ft, which may indicate the precise geolocation of the applicable driver.

5. Categories of Third Parties to Whom We Disclose Personal Information

We may disclose your Personal Information to the following categories of third parties:

Service Providers. We may disclose your Personal Information to third-party service providers to assist us with our recruiting, hiring, and administration of your employment, payroll, salary, and benefits, such as background check companies, recruiters and employment agencies, payroll providers, software service providers, learning resource management service providers, training service providers, human resource information systems service providers, data analytics providers and consumer reporting agencies in connection with pre-employment screening.

Social Media Companies. You may connect your LinkedIn profile to share more information with us in addition to your resume. You may also apply for certain jobs through LinkedIn. We will not ask for your password to any of your social media accounts.

Professional Advisors. We may share your Personal Information with our professional advisors, such as attorneys, accountants, financial advisors, insurance brokers and business advisors, in their capacity as advisors to use in our business, tax and legal matters.

Governmental Entities and Law Enforcement. We may disclose Personal Information about you to governmental authorities or law enforcement if required by law or if we reasonably believe that disclosing the Personal Information is needed to comply with any valid legal process, governmental request, or applicable law, rule, or regulation, to protect the company’s rights, property, and safety and those of our Workforce Members, customers, or others; or to detect and resolve fraud or security concerns.

Successor Entities. In the event CJ is subject to a merger, acquisition, or sale of its assets or another change of control, or in the case of a bankruptcy, reorganization or similar transaction, we will provide Personal Information in connection with the proposed or completed transaction, including that we may transfer your Personal Information to the subsequent owner(s).

6. How Long We Keep Your Personal Information

We will keep the Personal Information described in this Employee Privacy Notice only as long as we have a legitimate business purpose to keep it as required by law. When deciding how long to keep Personal Information we collect, we consider the nature and sensitivity of the Personal Information, the risk of harm in case of an unauthorized or inadvertent use or disclosure of Personal Information; the purposes for which we process Personal Information, whether we can fulfill those purposes through other means; and to comply with applicable legal and business requirements.

7. How We Protect Your Information

We maintain reasonable administrative, technical, and physical safeguards designed to protect the Personal Information we collect and process from unauthorized or unlawful access, acquisition, use, disclosure, alteration, loss, or destruction. While we take these measures to protect your Personal Information, no method of transmission or storage is completely secure. If your Personal Information collected in the Employment Context is impacted by a data breach, we will notify you as required under applicable law.

8. Children’s Data

We do not hire individuals under the age of 18. We only collect and disclose the Personal Information of children under the age of 18 strictly for the purpose of administering benefits.

9. Your California Privacy Rights

California Employees, Job Applicants, and Independent Contractors have certain privacy rights regarding their Personal Information under California law. We have provided below a summary of those privacy rights. Certain capitalized terms not defined in this Employee Privacy Notice have the meanings set forth in the California Consumer Privacy Act (“CCPA”).

Selling, Sharing, and Disclosure of Personal Information in the Last 12 Months

During the 12 months prior to the “Last Updated” date of this Employee Privacy Notice, we have not “Sold” your Personal Information to a third party for monetary compensation.

During the 12 months prior to the “Last Updated” date of this Employee Privacy Notice, we have not “Shared” your Personal Information with third parties to enable those third parties to assist us in connection with marketing, advertising, and analytics.

During the 12 months prior to the “Last Updated” date of this Employee Privacy Notice, we have disclosed the categories of Personal Information listed in Section 4 to our service providers who act on our behalf when they provide services to us. Our service providers are not permitted to share your Personal Information with third parties except as permitted by us for a limited business purpose and such service providers and their sub-contractor may not use your Personal Information for their own benefit.

Explanation of your California Privacy Rights

Subject to certain exceptions permitted by applicable law and verification of your identity, you may exercise the following rights with regard to your Personal Information:

Right to Know or Access your Personal Information. You have the right to request access to Personal Information collected in the Employment Context about you that was generated on or after January 1, 2022;

  • The specific pieces of Personal Information that we have collected from you.
  • The categories of Personal Information we collected from you.
  • The categories of sources from which the Personal Information was collected.
  • The categories of third parties to whom we have disclosed your Personal Information.
  • The categories of Personal Information that we sold or shared, or that we disclosed for a business purpose, and the categories of third parties to whom it was disclosed for a business purpose.
  • The business or commercial purpose for collecting, sharing, or selling your Personal Information.

Right to Request Deletion. You have a right to request that we delete certain Personal Information we collected from you. In many cases, we may deny such requests because we are required to keep that information to comply with applicable laws, to administer employment or benefits, to defend against legal claims and investigations, or for other purposes permitted by the CCPA.

Right to Correct. You have a right to request that we correct inaccurate Personal Information in your records.

Right to Data Portability. You may request a copy of the Personal Information you previously provided to us in a portable and, to the extent technically feasible, readily usable format.

Right to Non-Discrimination. You have a right not to receive discriminatory treatment for exercising any of your privacy rights under the CCPA.

Rights Related to Automated Decision-making Technology. We do not currently use automated decision-making technology to make significant decisions regarding your hiring, promotion, or termination. If we begin to use automated decision-making technology, you may have the right to receive notice, access meaningful information about the logic involved, opt out in certain contexts, and appeal adverse decisions, as applicable under the CCPA and its regulations.

Who May Exercise Your California Privacy Rights. Only you or an authorized agent may make a request to exercise your California privacy rights. To use an authorized agent, you must: (1) provide the authorized agent with written permission to make the request and (2) verify your own identity (per the process stated below), as well as the identity of the authorized agent. We may deny a request from an authorized agent if we do not have proof that the agent is authorized by you to act on your behalf.

Verifying a Data Subject Request. To verify your request, you must provide sufficient information that allows us to reasonably verify that you are the person about whom we collected Personal Information, and you must describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. To verify your identity, we may ask you to provide additional information.

Updates to this Employee Privacy Notice. We may update this Employee Privacy Notice from time to time. Any changes will be effective as of the date they are communicated to you. If we make any material changes, we will notify you by posting notice at the top of the website that we have updated our Employee Privacy Notice or by sending you a notification. We encourage you to review this Employee Privacy Notice regularly to stay informed about our privacy practices and your privacy rights.

10. Your Canadian Privacy Rights

Employees, Job Applicants, and Independent Contractors located in Canada have certain privacy rights regarding their Personal Information under Canadian law. The following additional provisions apply to our handling of your Personal Information.

  • Purposes and Limitation. We collect, use, and disclose Personal Information for the purposes specified in Section 4. We limit collection to what is necessary for those identified purposes and collect information only by fair and lawful means. We will only use or disclose your Personal Information for the purposes for which it was originally collected, unless we have your consent to use it for another purpose or are otherwise permitted or required by law. We may use your Personal Information without your knowledge or consent where required by applicable law or regulation.
  • Data Sharing. We will only disclose your Personal Information to third parties where required by law or to our employees, contractors, designated agents, or third-party service providers who require it to assist us with administering the employment relationship with you, including third-party service providers who provide services to us or on our behalf. Third-party service providers include, but are not limited to, payroll processors and benefits administration providers. These third-party service providers may be located outside of Canada or outside of your province of employment.
  • Cross-Border Transfers. Where applicable law permits, we may transfer the Personal Information we collect about you to the United States, as necessary to perform our employment contract with you and for the purposes set out in this Employee Privacy Notice. The United States may not provide the same level of privacy protection as Canada and your Personal Information may be subject to United States laws and requirements, including the obligation to disclose information to law enforcement and government agencies in certain circumstances.
  • Retention. We retain your Personal Information only as long as necessary to fulfill those purposes, subject to certain exceptions under applicable law. Under some circumstances we may anonymize your Personal Information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent. Once you are no longer a Workforce Member, we will retain and securely destroy your Personal Information in accordance with our document retention policy and applicable laws and regulations.
  • Accuracy. We take reasonable steps to ensure that your Personal Information is accurate, complete, and up-to-date as necessary for the purposes for which it is to be used. We encourage you to notify us of any changes to your Personal Information so that we can update our records accordingly.
  • Individual Rights. Subject to certain exceptions, you have the right to:
    • Access your Personal Information and request details about our handling of it.
    • Request correction or update of inaccurate or incomplete information.
    • Withdraw consent (subject to legal/contractual limits).
    • Request your computerized Personal Information in a structured, commonly used, machine-readable format and transmit it to another organization.
  • Exercising Your Rights. To exercise your privacy rights, contact us using the contact information below.
  • Retaliation. We will not retaliate against you for reporting, preventing, or refusing to engage in violations of applicable privacy laws, as long as you are acting in good faith and with a reasonable belief.
  • Safeguards. We use physical, organizational, and technical data security measures to protect your Personal Information from unauthorized access, disclosure, copying, use, or modification, based upon the sensitivity, volume, distribution and medium of that Personal Information.
  • Complaints. You have the right to challenge our compliance with applicable Canadian privacy laws by contacting our Privacy Officer. If you believe we have not respected the provisions of applicable Canadian privacy laws, please contact HR and attempt to resolve the matter with us. If we are unable to resolve the matter internally, you may file a complaint with the Office of the Privacy Commissioner of Canada at www.priv.gc.ca or 1-800-282-1376.
  • Updates to this Employee Privacy Notice. We may update this Employee Privacy Notice from time to time. Any changes will be effective as of the date they are communicated to you. If we would like to use your previously collected Personal information for different purposes than those we notified you about at the time of collection, we will provide you with notice and, where required by law, seek your consent, before using your Personal Information for a new or unrelated purpose. We may use your Personal Information without your knowledge or consent where required or permitted by applicable law or regulation.
